Affiliate Program Policy
This Affiliate Program Policy ("Policy") governs participation in the ThatSexQuiz.com affiliate program (the "Program"). By participating in the Program, you ("Affiliate") agree to be bound by this Policy, our Terms of Service, and our Privacy Policy. If you do not agree, do not participate.
1. Enrollment and Eligibility
Participation in the Program is by application or invitation only and may be granted, denied, suspended, or revoked at our sole and absolute discretion, at any time, with or without cause and with or without notice. We are under no obligation to explain any enrollment or termination decision. Affiliates must be at least 18 years of age and legally able to enter into contracts.
2. Independent Contractor Status
Affiliates are independent contractors. Nothing in this Policy creates an employment, agency, partnership, joint venture, or franchise relationship. Affiliates have no authority to make commitments or representations on our behalf. Affiliates are solely responsible for their own expenses, and for all taxes, filings, and reporting obligations arising from Program earnings.
3. Commissions and Tracking
Commission rates, tracking-cookie durations, attribution rules, and all other Program mechanics are set by us and may be changed at any time, for any reason, with or without notice, including retroactively where permitted by law. Referrals are tracked using cookies and similar technologies; we are not responsible for lost or misattributed referrals caused by cleared cookies, blocked tracking, browser or device behavior, technical failures, or any circumstance outside our direct control. Our records and measurements are final and binding for all determinations of referrals, commissions, and balances.
4. Refunds, Chargebacks, and Discounts
Commissions are calculated on net revenue actually received and retained by us. Amounts that are refunded, charged back, disputed, discounted, or otherwise not collected do not earn commission, and any commission previously credited on such amounts will be reversed or deducted from future payments.

Payment timing, method, minimum payout thresholds, and currency are at our discretion and may change at any time. Any dispute regarding a commission, balance, or payment must be raised in writing within thirty (30) days of the relevant statement or payment; otherwise, the amounts are conclusively deemed accurate and all claims relating to them are waived. Upon termination of an Affiliate for cause, all unpaid commissions are forfeited.
6. Prohibited Conduct
Affiliates must not: (a) engage in fraudulent, deceptive, or misleading practices; (b) refer themselves or coordinate purchases designed to generate commission; (c) bid on our trademarks or confusingly similar terms in paid search; (d) send spam or unsolicited communications; (e) misrepresent the Service, its results, or their relationship with us; (f) target minors or market in venues directed at minors; or (g) violate any applicable law or platform policy. Violation of this section results in immediate termination and forfeiture of all accrued and unpaid commissions.
7. Disclosure Compliance
Affiliates are solely responsible for complying with all disclosure requirements applicable to their promotions, including the U.S. FTC Endorsement Guides and equivalent rules in other jurisdictions. Affiliates must clearly and conspicuously disclose their material connection to us wherever they share affiliate links. We accept no responsibility or liability for any Affiliate's failure to make required disclosures.
8. No Guarantees
We make no representations or guarantees of any kind regarding earnings, traffic, conversion rates, Program continuity, or the availability of the Service. The Program is provided "as is" and "as available." We may modify, suspend, or discontinue the Program, in whole or in part, at any time without liability.
9. Indemnification
Affiliates agree to indemnify, defend, and hold harmless ThatSexQuiz.com, its owners, operators, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to the Affiliate's participation in the Program, their promotional activities, their content, or their breach of this Policy or applicable law.
10. Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability to any Affiliate arising out of or relating to the Program shall not exceed the total commissions actually paid to that Affiliate in the three (3) months preceding the event giving rise to the claim. In no event shall we be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits or lost business opportunities, even if advised of the possibility of such damages.
11. Termination and Changes
Either party may terminate participation at any time. We may amend this Policy at any time by posting an updated version; continued participation after posting constitutes acceptance. Sections 2, 4, 5, 9, 10, and 11 survive termination.
